AFFILIATE PROGRAM TERMS & CONDITIONS

These Affiliate Program Terms and Conditions ("Affiliate Terms") govern participation in the LinkBuild Affiliate Program ("Program").

By applying for or participating in the Program, you agree to be bound by these Affiliate Terms, the LinkBuild Terms and Conditions, Privacy Policy, and all applicable laws.

1. OVERVIEW

The LinkBuild Affiliate Program allows approved affiliates ("Affiliate", "you", "your") to earn commissions by referring new users to LinkBuild through approved promotional methods.

Participation in the Program does not create any employment, agency, partnership, franchise, or joint venture relationship between LinkBuild and the Affiliate.

2. ELIGIBILITY

To participate in the Program, you must:

• Be at least 18 years old.
• Have a valid LinkBuild account.
• Provide accurate registration information.
• Comply with all applicable laws and regulations.
• Be approved by LinkBuild.

LinkBuild reserves the right to accept or reject any affiliate application for any reason.

3. AFFILIATE LINKS

Upon approval, affiliates may receive:

• Unique referral links
• Tracking URLs
• Promotional materials
• Marketing assets

Commissions are only earned through properly tracked referrals.

LinkBuild is not responsible for commissions resulting from:

• Broken tracking links
• Improper affiliate implementation
• Browser restrictions
• Ad blockers
• Tracking prevention technologies

4. QUALIFIED REFERRALS

A Qualified Referral is a new customer who:

• Clicks an affiliate link.
• Creates a valid account.
• Completes a qualifying purchase.
• Is not already registered with LinkBuild.
• Is not referred through another affiliate.
• Is not associated with fraudulent activity.

LinkBuild reserves the right to determine whether a referral qualifies for commission.

5. COMMISSION STRUCTURE

Commission rates, payout percentages, and eligibility requirements will be displayed within the Affiliate Dashboard or Affiliate Program documentation.

LinkBuild reserves the right to modify:

• Commission percentages
• Commission structures
• Bonus programs
• Promotional incentives

at any time.

Changes shall not affect commissions already earned and approved before the effective date of the change.

6. COOKIE DURATION

Referral tracking may be based on cookies or other tracking technologies.

The applicable referral attribution period ("Cookie Window") will be specified in the Affiliate Program details.

If multiple affiliates refer the same user, commission attribution shall be determined according to LinkBuild's tracking system and attribution rules.

LinkBuild's decision regarding attribution shall be final.

7. PAYOUTS

Affiliate commissions are payable only after:

• Successful customer payment.
• Expiration of refund periods.
• Fraud review completion.
• Compliance verification.

Payments may be made monthly, quarterly, or according to the payout schedule specified by LinkBuild.

Affiliates are responsible for providing accurate payment information.

8. MINIMUM PAYOUT THRESHOLD

LinkBuild may establish a minimum payout threshold before commissions become payable.

Unpaid commissions below the threshold will roll over to future payment periods.

9. REFUNDS AND CHARGEBACKS

No commission shall be payable on:

• Refunded transactions.
• Reversed payments.
• Chargebacks.
• Fraudulent purchases.
• Disputed payments.

If commissions have already been paid on such transactions, LinkBuild reserves the right to:

• Deduct future commissions.
• Offset amounts owed.
• Suspend affiliate payments.

10. PROHIBITED PROMOTIONAL METHODS

Affiliates may not:

Spam

• Send unsolicited emails.
• Send bulk messages.
• Use automated spam tools.

Misleading Advertising

• Make false claims about LinkBuild.
• Promise guaranteed SEO results.
• Promise guaranteed rankings.
• Misrepresent platform features.

Trademark Abuse

• Register domains containing LinkBuild trademarks.
• Impersonate LinkBuild.
• Create fake LinkBuild websites.

Fraudulent Activity

• Self-referrals.
• Fake signups.
• Fake purchases.
• Incentivized fraud.
• Commission manipulation.

Unauthorized Advertising

• Unauthorized paid search campaigns.
• Unauthorized brand bidding.
• Deceptive advertising.

Violations may result in immediate termination.

11. CONTENT GUIDELINES

Affiliates may not promote LinkBuild through content that contains:

• Illegal content
• Hate speech
• Violence
• Adult content
• Malicious software
• Fraudulent schemes
• Copyright infringement

LinkBuild may require removal of content that negatively affects its reputation.

12. AFFILIATE DISCLOSURE REQUIREMENT

Affiliates must comply with applicable advertising and consumer protection laws.

Where required by law, affiliates must clearly disclose their affiliate relationship with LinkBuild.

Examples include statements such as:

"This page contains affiliate links. I may earn a commission if you purchase through my referral link."

Affiliates are solely responsible for compliance with disclosure requirements.

13. TAX RESPONSIBILITIES

Affiliates are solely responsible for:

• Tax reporting
• Income declarations
• VAT obligations
• GST obligations
• Local tax compliance

LinkBuild does not provide tax advice.

14. INTELLECTUAL PROPERTY

LinkBuild grants affiliates a limited, revocable, non-exclusive license to use approved promotional materials solely for participation in the Program.

Affiliates may not:

• Modify trademarks without permission.
• Claim ownership of LinkBuild intellectual property.
• Register confusingly similar domains or trademarks.

All rights remain the exclusive property of LinkBuild.

15. TERMINATION

LinkBuild may suspend or terminate an affiliate account at any time for:

• Policy violations.
• Fraudulent activity.
• Brand misuse.
• Reputation risks.
• Legal compliance concerns.

Termination may occur without prior notice.

16. COMMISSION FORFEITURE

Upon termination, LinkBuild may withhold unpaid commissions if:

• Fraud is detected.
• Terms are violated.
• Artificial referrals are identified.
• Abuse of the Program is discovered.

LinkBuild's determination shall be final.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law, LinkBuild shall not be liable for:

• Lost profits.
• Lost commissions.
• Business interruption.
• Technical failures.
• Tracking errors.
• Payment delays.
• Indirect damages.
• Consequential damages.

Participation in the Program is at the Affiliate's own risk.

18. NO GUARANTEE OF EARNINGS

LinkBuild does not guarantee:

• Affiliate income.
• Referral volume.
• Conversion rates.
• Sales performance.
• Future commissions.

Affiliate success depends on numerous factors outside LinkBuild's control.

Any earnings examples are illustrative only and do not constitute guarantees.

19. MODIFICATIONS TO THE PROGRAM

LinkBuild reserves the right to:

• Modify the Affiliate Program.
• Change commission rates.
• Update payout terms.
• Introduce new requirements.
• Suspend or discontinue the Program.

Changes will become effective upon publication.

20. GOVERNING LAW

These Affiliate Terms shall be governed by and interpreted under the laws of India, without regard to conflict of law principles.

Any disputes arising from the Affiliate Program shall be subject to the exclusive jurisdiction of the courts located in [Your City, State, India].
